How Long Will It be Before My Claim is Resolved?
There is no definite answer on how long it will take to resolve a claim because each claim is unique. The timeline for every claim varies. It depends on the complexity of the case, and it depends on the severity of the injuries.
If the case involves what is known as “soft tissue injury”, meaning that muscles and tendons are strained, then that case will resolve faster than a case where there are more significant injuries. Typically, a soft tissue injury case will resolve in six or seven months. Our law firm can have the case settled within that period of time; but if you should have a more severe injury, then, of course, it depends on your treatment protocol and how long you are treated until you have reached your maximum medical improvement. Again, this depends on your medical condition.
Additionally, other cases might depend on the complexity of the issues involved. For example, comparative fault might be a significant issue in your case. An issue of determining fault could prolong your case, and it could also require litigation.
Another issue that could be present in some of these claims that might prolong the resolution of the case would depend on what type of accident it was. Was it an intersectional collision where people are disputing whether there was a red light or a green light? Another issue regarding the type of accident would be a rear-end collision. Typically, rear-end collisions are resolved more quickly than an intersectional collision because the driver of a rear-ending vehicle is presumed to be at fault. So, that is an easier proposition to resolve in a faster period of time. However, this of course depends on the type of injuries sustained.
